Immunization of Minors on TANF does not include adoption or approval information. ALEC has attempted to distance itself from this piece of legislation after the launch of ALECexposed.org in 2011, but it has done nothing to get it repealed in the states where it previously pushed for it to be made into law.

This Act requires that applicants for Temporary Assistance for Needy Families (TANF) must provide verification that eligible children have received immunizations according to the age of the child by the first scheduled re-determination of eligibility. The TANF grant will be eliminated for applicants who do not provide verification of immunizations. Exceptions to this Act can be sought for religious and medical reasons.

Model Legislation

{Title, Enacting clause, etc.)

Section 1. (Title)

This Act may be cited as Immunization for Minors on TANF.

Section 2. (Definitions.)

  • “Applicant” means individual who has met the TANF eligibility requirements
  • “Department” means the appropriate state level Department of Social Services

Section 3. (Verification of Immunization.)

A. Applicants for TANF will provide verification to the Department that all otherwise eligible children have received require immunizations according to the age of the child by the first scheduled re-determination of eligibility.

B. The TANF grant will be eliminated for those who are unable to provide verification or immunizations.

C. Current recipients at the time of implementation will be required to comply by the first scheduled re-determination of assistance after notification of the immunization guidelines.

D. There are exceptions for meeting this requirement for religious reasons and medical reasons.

Section 4. (Severability clause.)
